These Terms of Service ("Terms") govern access to and use of the WESEP Orbe service (the "Service") provided by SINIAMIN OVERSEAS (SIRET 833 549 785, 10 Route de Balata, 97234 Fort-de-France, Martinique, France), trading as WESEP, accessible at wesep.com.
By creating an account or using the Service, you acknowledge that you have read, understood, and accepted these Terms in their entirety without reservation. If you do not accept these Terms, you must refrain from using the Service.
WESEP reserves the right to amend these Terms. Any material change will be notified by email with 30 days' prior notice. Continued use of the Service after this period constitutes acceptance of the updated Terms.
- WESEP: the company that publishes and operates the Service. - Orb: an encrypted digital message created by a User, intended for delivery to a Beneficiary on a specified date. - User or Creator: any adult individual holding a WESEP account who has created at least one Orb. - Beneficiary: the individual designated by the User to receive an Orb. - Credit: a consumable unit required to seal an Orb containing media (audio, video, or document). - Sealing: the irreversible operation of encrypting an Orb with AES-256-GCM and applying a cryptographic time lock. - Archiving: the permanent deposit of a sealed Orb on the Arweave decentralised storage network.
The Service is available to individuals aged 18 or over with full legal capacity to enter into contracts. By using the Service, you represent that you meet these requirements.
To create an account, you must provide a valid email address and choose a password. Your account is personal and non-transferable. You are solely responsible for the confidentiality of your credentials and for all activity carried out under your account.
In the event of loss or compromise of your credentials, you agree to notify WESEP immediately at contact@wesep.com.
WESEP Orbe is a service for creating, encrypting, time-locking, and transmitting digital messages (text, audio, video, document). The Service enables any registered User to:
- Create an Orb (text messages are free and unlimited; media requires credits) - Encrypt and seal the Orb with a cryptographic time lock - Archive the Orb permanently on the Arweave network - Record an existence proof on the Scroll L2 blockchain - Designate a Beneficiary (by email or phone) who will receive the Orb on the chosen delivery date - Download a PDF certificate of authenticity for the Orb
Credits Text Orbs are free. Orbs containing media (audio, video, document) require credits, debited at the time of sealing. The number of credits required depends on the type and volume of media. Additional credits can be purchased from the Credits section.
By using the Service, you agree to:
- Provide accurate information at registration and keep it up to date - Not use the Service for unlawful, fraudulent, defamatory, threatening, or public-order-violating purposes - Not upload content that infringes third-party rights (copyright, image rights, privacy) - Not attempt to circumvent the Service's security mechanisms - Not use the Service to transmit hateful, discriminatory, or dignity-violating content - Obtain the designated Beneficiary's consent where required by applicable law
Any breach of these obligations may result in immediate account suspension, without prejudice to any legal action.
The User is solely responsible for the content they create and store in their Orbs. WESEP does not monitor Orb content and cannot technically access it once sealed (end-to-end encryption).
By creating an Orb, the User warrants that the content is lawful, does not infringe any third-party rights, and does not violate any legal or regulatory provision. In the event of a third-party claim relating to Orb content, the User agrees to indemnify WESEP against all resulting loss, costs, and proceedings.
Orbs archived on Arweave are stored permanently and immutably. Once archived, the content of an Orb cannot be removed from the Arweave network for any reason.
WESEP's rights All elements of the Service (source code, interface, brand, logo, technical architecture) are the exclusive property of WESEP and protected by French and international intellectual property law. Any reproduction, representation, or use without prior written authorisation is strictly prohibited.
User rights over their content Users retain full intellectual property rights over the content of their Orbs. By using the Service, the User grants WESEP a limited, non-exclusive licence strictly necessary to perform the Service (encryption, archiving, delivery to the Beneficiary).
WESEP commits to keeping the Service available 24/7, subject to planned maintenance and force majeure events.
In the event of planned downtime, WESEP will inform Users with reasonable prior notice. WESEP shall not be liable for interruptions beyond its control (network outage, force majeure, sub-processor incident).
Long-term Orb access guarantee Orbs archived on Arweave and recorded on the Scroll blockchain are accessible in a decentralised manner, independently of the WESEP Service. The standalone reader (accessible at the address recorded on Arweave) enables access to and decryption of Orbs even if wesep.com is unavailable.
Current pricing is displayed on the Pricing page of the Service. WESEP reserves the right to change its pricing with 30 days' email notice.
Payments are made via Stripe and are secured. WESEP does not have access to the User's banking data.
Refunds Unused credits are non-refundable, except in the event of Service closure by WESEP or a manifest billing error. Credits consumed when sealing an Orb that is subsequently deleted are automatically restored.
In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal does not apply to contracts for the supply of digital content where performance has begun before the end of the withdrawal period, with the consumer's prior express consent.
By purchasing WESEP credits and sealing an Orb, you expressly acknowledge and agree that: - the digital service (sealing, encryption, archiving) is fully performed upon the use of those credits; - you expressly waive your right of withdrawal in respect of the credits so consumed.
Credits that have not been consumed remain refundable upon request within 14 days of the purchase date. To submit a request, contact: contact@wesep.com.
An Orb may be deleted by its creator at any time before sealing, free of charge. Once sealed, an Orb may be cancelled by its creator subject to a cancellation fee of €10.00.
This fee covers the permanent archiving costs already incurred (registration on the Arweave network, which is immutable and irreversible by nature). Orb credits consumed during sealing are refunded, but the cancellation fee is non-refundable.
Cancellation requests should be sent to contact@wesep.com, quoting the identifier of the Orb concerned. WESEP will process the request within 48 business hours.
Users may close their account at any time from their Profile page. Closure results in the deletion of personal data within 30 days, in accordance with the Privacy Policy.
WESEP may suspend or terminate an account for breach of these Terms, after notification (unless urgency arising from a serious breach justifies immediate action). Where WESEP terminates for User fault, any remaining credits are not refunded.
Effect of termination on Orbs Orbs already archived on Arweave remain accessible via the standalone reader. Orbs not yet archived will be permanently deleted.
WESEP's obligation in respect of the delivery of Orbs to Beneficiaries is one of means, not results (in particular where an invalid email address or phone number has been provided by the User).
In no event shall WESEP be liable for: - Indirect or consequential loss (loss of chance, moral damages) - Consequences of the User's loss of credentials - Service interruptions caused by third parties or force majeure events - The content of Orbs created by Users
WESEP's liability, if established, is capped at the sums actually paid by the User in the 12 months preceding the event giving rise to the claim.
These Terms are governed by French law.
In the event of a dispute relating to the interpretation, performance, or termination of these Terms, the parties agree to seek an amicable resolution within 30 days before initiating legal proceedings.
Failing an amicable resolution, the courts in the jurisdiction of WESEP's registered office shall have sole jurisdiction, unless mandatory consumer-protection rules provide otherwise.
